Most operators know they have an Operator Licence. Fewer know exactly what undertakings they agreed to when that licence was granted.

The problem is that undertakings often sit in a filing cabinet or computer folder for years without being reviewed. Meanwhile, staff change, systems evolve, and before long, the business may no longer be operating in line with the commitments it originally made.

We recently worked with an operator who was confident their compliance systems were robust. During an audit, we reviewed their Operator Licence undertakings and discovered they had committed to carrying out specific compliance checks every month. The checks had gradually stopped over time, simply because nobody remembered the undertaking existed.

When you apply for an Operator Licence, you agree to a series of undertakings. These may include:

  • Keeping vehicles fit and serviceable
  • Ensuring drivers report defects promptly
  • Maintaining proper drivers' hours records
  • Operating within authorised vehicle numbers
  • Ensuring sufficient financial standing
  • Managing compliance effectively through the Transport Manager

Some operators may also have additional undertakings imposed following a Public Inquiry or regulatory intervention.

The Traffic Commissioner expects operators to actively comply with these commitments. Failure to do so can lead to questions about your repute, management control, and overall compliance systems.

Best practice includes:

  • Reviewing your undertakings at least annually
  • Keeping a copy readily available for management staff
  • Including undertakings within internal compliance audits
  • Discussing them during Transport Manager reviews
  • Ensuring key staff understand their responsibilities
